Terms of Service

1. Contractual Relationship

These Terms of Service ("Terms") constitute a legally binding agreement between Websitesca Inc. ("Company," "we," or "us") and the business entity registering for an account ("Client," "you"). These Terms are governed by the laws of Canada and applicable provincial regulations.

2. Description of Service

Company provides an automated, inbound AI voice platform built utilizing proprietary software alongside third-party telecommunication and artificial intelligence systems. The service answers incoming calls, generates voice responses, and creates automated text transcriptions for the Client's internal business use.

3. Mandatory Recording Disclosure (Client's Legal Obligation)

The Client acknowledges that Canadian law requires individuals to be notified if a telephone call is being recorded. The Client assumes 100% legal responsibility for ensuring that a clear, audible disclosure statement (e.g., "This call is handled by an AI assistant and is recorded for quality purposes") plays immediately at the start of their inbound call routing.

The Company provides the tools to play this message but accepts zero liability if the Client fails to implement, alters, or disables this recording warning. You agree to indemnify Websitesca Inc. against any regulatory penalties, privacy complaints, or legal claims arising from a failure to notify your callers.

4. Data Ownership and License

As between you and the Company, the Client retains 100% ownership over all call recordings, customer metadata, and generated text transcripts. You grant Websitesca Inc. and its technology partners a narrow, limited license to process, transcribe, and host this data solely to deliver the service to your account.

5. Reliance on Third-Party Technology Infrastructure

The Client acknowledges that our service relies directly on automated cloud systems and language models for its core processing.

  • No Guarantee of Perfection: AI-generated transcripts and speech are automated and can occasionally contain errors, hallucinations, or inaccuracies.
  • System Disruptions: We are not liable for service outages, dropped calls, or lag caused by interruptions in underlying telecommunications, artificial intelligence models, or general internet routing.

6. Billing, Term, and Cancellation

Billing Cycle: All services are billed in Canadian Dollars (CAD) on a pre-paid, month-to-month basis. Payment for the upcoming service month is automatically charged to the Client's authorized payment method on file at the commencement of each billing cycle.

Taxes: Applicable Canadian sales taxes (GST, HST, or PST) will be calculated and applied automatically at checkout based strictly on the billing and business address provided by the Client.

Cancellation Policy: The Client may terminate their service at any time by providing a mandatory one (1) month written notice of cancellation. Following the receipt of a cancellation request, the service will remain active, and the Client will be responsible for all pre-paid fees through the end of the final billing period concluding after the notice window. No prorated refunds will be issued for partial months of service.

7. Limitation of Liability

To the maximum extent permitted by law, Websitesca Inc. shall not be liable for any indirect, incidental, or consequential damages, including lost revenue, missed customer appointments, or business disruptions, resulting from the use or inability to use the AI voice platform.
